The infrastructure and project finance market is a dynamic and challenging space. The ever-present need to build new infrastructure, and rehabilitate existing networks, results in an immense need for funding.

Across many jurisdictions, transport networks, high-speed internet connectivity, schools and public building projects are in desperate need of investment. While public-private partnerships (PPPs) have stepped up to the plate in recent years, allowing countries to launch ambitious infrastructure projects which may not have been possible otherwise, the market has been profoundly impacted by COVID-19.

In badly-affected countries, tax revenues have declined while government borrowing has soared. Infrastructure projects undergoing construction have slowed. Budgetary constraints and infrastructure’s pivotal role as a driver for economic recovery may see PPPs take on a crucial role in the long term.

In this environment, disputes are likely to rise as more parties fail to meet their contractual obligations around infrastructure projects. Force majeure clauses have become a focal point for those seeking relief, although much depends on whether the clause mentions specific relevant events and whether that list is exhaustive or non-exhaustive.

Against this backdrop, Financier Worldwide turns to some of the leading lights in their field, who share their stories…
